Effective 2/1/2023, electronic remote notarization is now active in New York State. Electronic notarial acts are notarial acts performed using software that produces an electronically recorded output.
An electronic notarial act is performed remotely, with the notary and petitioner separated physically, but capable of communicating at the same time through audio-visual technologies and other security protocols. Under the new law, remotely notarized documents will be accepted for record by the New York county clerk and other government offices. Visit my Remote Online Notarization page for more information.

Yes. In order for me to notarize a document, New York State law says the person whose signature is being notarized must sign the document in the notary’s presence.
The person can’t sign the document ahead of time and then bring it to the notary.

Acknowledgments — The purpose of an acknowledgment is to ensure that the document’s signer is who they claim to be and has voluntarily signed the document. (often needed for documents concerning valuable assets, such as deeds, mortgages, and deeds of trust)
Jurats (Oath/Affirmation) — The purpose of a jurat is for you to swear or affirm that the contents of the document are true (an oath is a solemn pledge to a Supreme Being while an affirmation is a solemn pledge on the individual’s personal honor.)

Acceptable ID must be issued by a government agency and include the bearer’s recent photograph, signature and physical description.

The signer’s appearance and valid state identification must be present upon meeting for every signer on the documents. The ID cannot be expired more than two years.

Qualifications of a Credible Witness.
– Must personally know signer.
– Must be honest, aware, and impartial.
– Must take an oath/affirmation to vouch for. signer's identity.

According to NYS notarial law, a notary CANNOT CERTIFY A COPY OF ANY LEGAL DOCUMENT even if a foreign government requests it. A notary CAN CERTIFY THE SIGNER’S STATEMENT ATTESTING TO THE DOCUMENT’S VALIDITY.
